The web/mobile/tablet application Refernearnnow.in (hereinafter referred to as "Application" or “App†or “Refernearnnow.inâ€), is owned by Refernearnnow.in Near Nutan School, 302, T-14, Sej plaza CSL, marve road, Malad West, Mumbai, Mumbai Suburban, Maharashtra, 400064
For the purpose of these Terms of Use, along with any amendments to the same, and wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a user of the Application by installing the Application. The term "We", "Us", and "Our" shall mean Refernearnnow.in.in and Refernearnnow.in. “Agreement†shall mean and refer to this Terms of Service, including any amendments that may be incorporated into it. “Third Party†shall mean and refer to any individual(s), company or entity apart from the User and Refernearnnow.in.
The headings of each section in this Agreement are only for the purpose of organising the various provisions under this Agreement in an orderly manner. These headings shall not be used by either party to interpret the provisions contained with them in any manner. Further, the headings have no legal or contractual value.
By using the App, You accept and agree to be bound by this Agreement, the Privacy Policy, as well as rules, guidelines, policies, terms, and conditions applicable to any service that is provided by this Application, that shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. Your use of Our Application is evidence that You have read and agreed to be contractually bound by these Terms of Service and our Privacy Policy. Please read both carefully. The use of this Application by You is governed by this policy and any policy so mentioned by terms of reference.
If you do not agree with any of these terms, please discontinue using the Application.
We hold the sole right to modify the Terms of Service without prior permission from You or providing notice to you. The relationship creates on You a duty to periodically check the Terms of Service and stay updated on its requirements. If you continue to use the Application or avail of its services following such change, it is deemed as consent by You to the so amended policies. Your continued use of the Application is conditioned upon Your compliance with the Terms of Service, including but not limited to compliance with the Terms of Service even after alterations if any.
We shall neither be liable nor responsible for any actions or inactions of Vendors and/or Sellers or any breach of conditions, representations or warranties by the Vendor or manufacturer of the products. Refernearnnow.in does not sell or retail any products and does not ensure that the Users shall perform their obligations in respect of the transaction concluded on this Application and further expressly disclaims any warranties or representations express or implied in respect of quality, safety, merchantability, fitness for a particular purpose, or legality of the products listed and transacted on Website.
MOBILE VERIFICATION
To fully avail of the services of the Application and use it, you must download the app from the ‘Google Playstore APP’, and verify its phone number. This APP supports all Android devices running an Android Version 2.3 and above. However, the use of this APP is available only to those above the age of 18, barring those “Incompetent to Contract†which inter alia include insolvents, as described in the Indian Contract Act, 1872.
COMMUNICATIONS:
By using this Application, it is deemed that You have consented to receive telephonic calls, SMSs and/or emails from Us at any time We deem fit. Such communications shall be sent to you on the telephone number and/or email id provided by You for the use of this Application which are subject to our Privacy Policy. Such communication by Us is for purposes that inter alia include clarification calls, marketing calls, and promotional calls.
You may also be contacted by Third Parties whose apps you came to be aware of through Refernearnnow.in.in, or installed on to your system to avail of any free talk-time scheme on Refernearnnow.in.
The sharing of the information provided by You shall be governed by the Privacy Policy.
OFFERS, CASHBACK / CREDITS, AND RECHARGE
In order to earn cashback/credits using the App, the User needs to complete an Offer on Refernearnnow.in.in as set forth by our vendors. The terms for each offer may vary from offer to offer, and vendor to vendor.
When you fulfil an offer set forth by the vendor, and the vendor in question is aware of your fulfilment of such offer, the vendor confirms the same to Us. Upon receipt of such confirmation, we shall transfer cashback/credits to the Refernearnnow.in.in Wallet that shall be linked to the account of the User.
The cashback/credits are transferred to the account of the User after the expiry of such time. However, the cashback/credits can be earned only if the User is downloading a new App onto the device.
The cashback/credits may reflect in the user’s account as per the duration for cashback confirmation that has been mentioned against the offer and only after the offer has been completed, as per the Offer terms provided and we have been intimated of the completion of the offer by the respective vendor. The User is advised to contact Refernearnnow.in.in Support if such cashback / Credits are not reflected in the account even after such duration.
Once the User has collected a certain minimum number of Cashback / Credits, he can recharge his pre-paid / post-paid mobile number for free talk-time.
The User may also use the cashback / Credits to get Value Added Services, as per the terms set forth by Refernearnnow.in.
The User may use the Refernearnnow.in.in referral system to earn further cashback / credits by inviting other persons to use Refernearnnow.in.in. The user shall be entitled to the cashback / Credits only if such referrals installed Refernearnnow.in.in for the first time using the user’s referral link.
The User may even port his number by changing the correct operator name.
The User shall not be allowed to transfer cashback / credits earned to a new device as the Refernearnnow.in.in account is tied to the device itself.
All text, recharge plans and tariff information gathered from Telecom Companies are owned by telecom companies and are all third party user generated content which we have no control over. We are merely an intermediary to such recharges for the purposes of this Terms of Use. It is hereby specifically disclaimed that we shall under no circumstances be liable for any failure to recharge or any other complication arising from a recharge transaction we facilitate through multiple third parties. The user hereby directed to communicate with such third parties directly for any transactional issues.
Cashback related to offer tasks such as app install & registrations will be credited to your Refernearnnow.in.in wallet within 24 hours of task / offer completion, subject to fulfilment of terms and conditions.
Cashback related to offer tasks such as transactions, deposits, bookings, KYC & account opening will be credited to your Refernearnnow.in.in within 90-120 days from the date of task / offer completion, subject to fulfilment of terms and conditions.
EXPIRY OF REFERNEARNNOW.IN.IN CASHBACK / CREDITS
Cashback credited into the user’s Refernearnnow.in.in Wallet will expire if not withdrawn within 60 days from the date of credit. This includes Cashback earned in any form (offers, surveys as well as bonuses). Users will have to withdraw the cashback subject to the minimum and maximum withdrawal limits within 60 days of the date of credit and before it’s expiry.
If the confirmed cashback amount available in the user’s wallet is below the minimum limits for withdrawal, it is upon the user to earn additional cashback until the minimum amount limits have met for withdrawal.
Cashback once expired will not be available for withdrawal or any other purpose and it won’t be reversed or be made available again. No claims for expired cashback will be entertained. Refernearnnow.in reserves the right to make changes to the expiry duration and criteria at it’s own descretion without any prior intimation to users.
Illustration: If a user avails an offer and cashback is confirmed and credited to the Refernearnnow.in.in wallet on May 1st, user will have to withdraw this amount before June 29th of the same year (60 days), failing which the cashback will expire and won’t be available.
In the above example, if the cashback credited is Rs. 75, and, minimum withdrawal limit is Rs. 100, the user will have to earn an additional Rs. 25 confirmed cashback before 29th June in order to withdraw, failing which the Rs. 75 will expire. The same process applies with the Rs. 25 earned which will expire in 60 days from the date of credit, unless withdrawn before expiry duration.
CASHBACK / CREDIT & REVERSAL TERMS
Providing of Refernearnnow.in.in cashback is solely dependent on confirmation of the purchase by the Advertiser/Vendor. You hereby acknowledge and agree that in case of failure of confirmation of a by an Advertiser/Vendor or non-payment of commission by the Advertiser/Vendor to Refernearnnow.in, Refernearnnow.in may refuse to credit any form of Credit to Users Refernearnnow.in.in Account. Refernearnnow.in also reserves the right to cancel pending or confirmed/earned cashback, withdrawal requests or withhold cashback indefinitely if we detect unscrupulous activity, any kind of fraud(including self-referral) or fraudulent post backs made by the user. Refernearnnow.in reserves the right to reduce or remove the available cashback amount without any prior notice, based on our sole discretion. We may also make changes to the expiry period to the cashback earned without any prior notice, and reduce, remove or make changes to the available cashback amount if you do not withdraw it before the
expiry date.
Refernearnnow.in reserves the right to terminate all past, pending and future offers including Cashback(s) of User(s), without assigning any reason, at its sole discretion without any liability arising out of the foregoing action(s) of Refernearnnow.in.
Refernearnnow.in reserves the right to modify/change all or any of the terms of applicable to Cashback(s), Offer(s) without assigning any reason or without any intimation whatsoever to Users. Further, Refernearnnow.in also reserves the right to discontinue the Credit(s)/Cashback(s) offer without assigning any reason or without any prior intimation whatsoever.
DISCLAIMERS
Refernearnnow.in.in does not endorse any product sold by our partners/merchants/advertisers. Any product/service contained in the transaction made by the user is at the user's sole discretion and the onus of its fulfilment is upon the seller/advertiser/merchant/partner.
Refernearnnow.in.in / Refernearnnow.in doesn't make warranties on any offer/task made on this application. All offers and their terms are provided by our vendors and we hold no title or interest over them.
The User participates in the completion of tasks/offers at their sole discretion. Refernearnnow.in.in does not endorse any product or service provided by the advertiser.
Refernearnnow.in.in assumes no liability for the repercussions of downloading any application for the purpose of fulfilling any vendor offers, including without limitation, loss of data, failure to boot, or other errors in the working of the device on to which an application has been downloaded.
Refernearnnow.in.in assumes no liability for cashback to be transferred to the Refernearnnow.in.in wallet of the User for any successful offer being completed. The acts of any user downloading any application and verification of the terms of the offer are done by our Vendors and we take no part in such verification.
Refernearnnow.in.in shall provide the User with the cashback to their Refernearnnow.in.in wallet only upon an intimation from its vendors of any user successfully completing the terms of such offer as applicable. If Refernearnnow.in.in does not receive a confirmation/intimation from the respective vendor, Refernearnnow.in.in shall not be liable to transfer/provide cashback to the User.
Refernearnnow.in.in is an application used by its vendors to promote other applications. By using Refernearnnow.in.in and taking part in an offer, the User understands and accepts that Refernearnnow.in.in does not endorse the downloading of any application.
The User acknowledges that all applications downloaded to take part in any offer are third party applications and Refernearnnow.in.in holds no title, interest, or liability on such applications. The User further acknowledges that the third-party applications downloaded may have their specific terms of use and policies which denote the user’s rights and liabilities with respect to the specific application. Refernearnnow.in.in shall hold no liability for the same. Refernearnnow.in.in shall attempt to resolve disputes regarding fulfillment of offers by users on a best-efforts basis but shall hold no liability for either the cashback being transferred to the Refernearnnow.in.in wallet, or the cashback being stored/utilised for any specific purpose.
Any disputes arising out of the use of Refernearnnow.in.in shall be governed by the law, rules, and regulations of India, as applicable in the State of Maharashtra. The exclusive jurisdiction and venue for actions and disputes shall be the courts located in Mumbai.
USER’S OBLIGATIONS
The User undertakes to fulfil the following obligations. Failure to satisfy any of these obligations gives Us the right to permanently suspend Your account and/or claim damages for any losses that accrue to Us or additional costs that may be imposed on us.
You hereby certify that you are at least 18 years of age.
You agree to comply with all local laws and regulations governing the downloading, installation and/or use of the Application, including, without limitation, any usage rules set forth in this Agreement. You undertake not to:
Cut, copy, distribute, modify, recreate, reverse engineer, distribute, post, publish or create derivative works from, transfer, or sell any information or software obtained from the Application. For the removal of doubt, it is clarified that unlimited or wholesale reproduction, copying of the content for commercial or non-commercial purposes and unwarranted modification of data and information within the content of the Application is not permitted. Should you want to engage in one or more such actions, prior permission from Us must be obtained.
Access (or attempt to access) the Application and/or the materials or Services by any means other than through the interface that is provided by the Application. The use of deep-link, robot, spider or other automatic devices, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Application or Content, or in any way reproduce or circumvent the navigational structure or presentation of the Application, materials or any Content, to obtain or attempt to obtain any materials, documents or information through any means not specifically made available through the Application is prohibited. You acknowledge and agree that by accessing or using the Application or Services, You may be exposed to content from other Users or Third Parties that You may consider offensive, indecent or otherwise objectionable.
We disclaim all liabilities arising in relation to such offensive content on the Application. Further, You may report such offensive content.
Use the Application in any manner that may impair, overburden, damage, disable or otherwise compromise (i) Refernearnnow.in’s services; or (ii) the Offers on the App. Use the Cashback earned to further any unlawful purposes or to conduct any unlawful activity, including, but not limited to, fraud, embezzlement, money laundering or identity theft.
Use the Cashback earned to abuse, harass, threaten, defame, disillusion, erode, abrogate, demean or otherwise violate the legal rights of others; engage in any activity that interferes with or disrupts access to the Application or the Services (or the servers and networks which are connected to the Application); Probe, scan or test the vulnerability of the Application or any network connected to the Application, nor breach the security or authentication measures on the Application or any network connected to the Application. You may not reverse look-up, trace or seek to trace any information on any other user, of or visitor to, the Application, or exploit the Application or Service or information made available or offered by or through the Application, in any way whether or not the purpose is to reveal any information, including but not limited to personal identification information, other than Your own information, as provided for by the Application; disrupt or interfere with the
security of, or otherwise cause harm to, the Application, systems resources, servers or networks connected to or accessible through the Applications or any affiliated or linked applications; violate any applicable laws or regulations for the time being in force within or outside India; violate any code of conduct or other guidelines, which may be applicable for or to any particular Service;
UPDATES
From time to time, the Application may automatically check the version of the Application installed on the Authorised Device and, if applicable, provide updates for the Application (hereinafter referred to as “Updatesâ€). Updates may contain, without limitation, bug fixes, patches, enhanced functionality, plug-ins and new versions of the Application. By installing the Application, You authorize the automatic download and installation of Updates and agree to download and install Updates manually if necessary. Your use of the Application and Updates shall be governed by this Agreement (as amended by any terms and conditions that may be provided with Updates).
ACTIONS UNDERTAKEN BY THE APPLICATION ON YOUR DEVICE:
Upon download and installation of the Application, You grant the following permissions to the Applications to perform the following actions on the device You have installed the Application in.
To read from, write on, modify and delete data pertaining to the Application on the device’s hard disk and/or external storage;
To access information about networks, access networks including wifi networks, receive and send data through the network;
To determine Your approximate location from sources like, but not limited to mobile towers and connected Wi-Fi networks;
To determine Your exact location from sources such as, but not limited to GPS.
To access the model number, IMEI number and details about the operating system of the device the Application has been installed on, as well as the phone number of the device.
To retrieve information about other applications running on the device the Application has been installed on and open them.
To detect when the phone had been switched off and switched on for the purpose of sending notification/ push notifications.
To access and change the display and sound settings of the device the Application has been installed in.
COPYRIGHT
All information, content, services and software displayed on, transmitted through, or used in connection with the Application, including for example Offers, text, photographs, images, illustrations, audio clips, video, html, source and object code, trademarks, logos, and the like (collectively and hereinafter referred to as the "App Content"), as well as its selection and arrangement, is owned by Us other Third Parties. You may use the App Content only through the Application, and solely for your personal, non-commercial use.
You may not republish any portion of the App Content on any Internet, Intranet or extranet site or incorporate the App Content in any database, compilation, archive or cache. You may not distribute any App Content to others, whether or not for payment or other consideration, and you may not modify, copy, frame, cache, reproduce, sell, publish, transmit, display or otherwise use any portion of the App Content. You may not scrape or otherwise copy the App Content without permission. You agree not to decompile, reverse engineer or disassemble any software or other products or processes accessible through the Application; not to insert any code or product or manipulate the content of the Application in any way that affects the user's experience, and not to use any data mining, data gathering or extraction method.
THIRD-PARTY INFORMATION
The content on the Application which includes all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, design documents, and artwork is a combination of Third Party Content and Our content. We have no control over such third-party user-generated content as We are merely an intermediary for the purposes of this Terms of Service. In the event, that any of the Third Party Content infringes any Intellectual Property of any person, the User shall be solely responsible for any loss caused and We shall not be liable. The use of such content and it being reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including "mirroring") to any other computer, server, Website, Application or other mediums for publication or distribution or for any commercial enterprise, without Our express prior written consent is not allowed.
INDEMNIFICATION
You shall indemnify and hold harmless to Refernearnnow.in and (as applicable) Refernearnnow.in's parent, subsidiaries, affiliates, third-parties and their respective officers, directors, agents, and employees, from any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon the use of User's actions or inactions, including but not limited to any warranties, representations or undertakings or in relation to the non-fulfilment of any of its obligations under this Agreement or arising out of the User's infringement of any applicable laws, regulations including but not limited to Intellectual Property Rights, Confidentiality obligations, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. You agree to fully cooperate in indemnifying Us at Your expense. You
also agree not to reach a settlement with any party without Our consent.
This clause shall survive the expiry or termination of this Agreement.
TERMINATION /SUSPENSION
Refernearnnow.in reserves its right to limit, refuse service, restrict, suspend, prohibit access to the Application, terminate your account and services; (Terminate this Agreement; Terminate or suspend your access to the Application; Move, or remove any product or service that is available on or through the Services; Deactivate or delete your accounts and all related information and files in your account; Establish general practices and limits concerning use of this Application) at any time, in its sole discretion with or without cause, and with or without any prior notice for any violation of the Terms of Use. Upon such termination or suspension, your right to use the Refernearnnow.in.in application will immediately cease. Once the User's registration or the Services are terminated, canceled or suspended, any data that the User has stored on the application may not be retrieved later. The User agrees that Refernearnnow.in (Refernearnnow.in.in) may under certain circumstances and
without prior notice, immediately terminate the User's user ID and access to the Application/Services. Causes for termination may include, but shall not be limited to requests by enforcement or government agencies, possible legal liabilities, infringing the intellectual property rights of any third party, anything acting inconsistently with the letter of spirit of our policies or harassing our employees, etc.
DISCLAIMER OF WARRANTIES/LIMITATION OF LIABILITY
THE APPLICATION, SERVICES AND OTHER MATERIALS ARE PROVIDED BY THIS APPLICATION IS ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL HAVE NO LIABILITY RELATED TO USER CONTENT ARISING UNDER INTELLECTUAL PROPERTY RIGHTS, LIBEL, PRIVACY, PUBLICITY, OBSCENITY OR OTHER LAWS. THE WEBSITE ALSO DISCLAIMS ALL LIABILITY WITH RESPECT TO THE MISUSE, LOSS, MODIFICATION OR UNAVAILABILITY OF ANY USER CONTENT.
THE USER ACKNOWLEDGES THAT THROUGH THIS SITE, REFERNEARNNOW.IN MERELY ACTS AS A FACILITATOR, IN ORDER TO FACILITATE THE HIGHEST QUALITY SERVICES TO THE USERS. REFERNEARNNOW.IN DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THIS APPLICATION WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS APPLICATION OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, BUT SHALL ENDEAVOUR TO ENSURE USER FULLEST SATISFACTION.
REFERNEARNNOW.IN IS NOT LIABLE FOR ANY CLAIMS AGAINST LACK OR DEFICIENCY OF SERVICES; NON-FULFILLMENT OR UNSATISFACTORY FULFILLMENT OF PRODUCTS AND SERVICES PURCHASED BY THE USER FROM THE THIRD PARTY. THUS, REFERNEARNNOW.IN SHALL NOT HAVE ANY LIABILITY WHATSOEVER FOR ANY ASPECT OF THE ARRANGEMENTS BETWEEN THE USERS OF THE APPLICATION AS REGARDS THE STANDARDS OF PRODUCTS AND SERVICES. IN NO EVENT SHALL REFERNEARNNOW.IN BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY OTHER DAMAGES RESULTING FROM: (A) THE USE OR THE INABILITY TO USE THE PRODUCTS AND SERVICES; (B) THE COST OF PROCUREMENT OF SUBSTITUTE PRODUCTS AND SERVICES; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF THE USER'S TRANSMISSIONS OR DATA; (D) ANY OTHER MATTER RELATING TO THE SERVICES; INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE APPLICATION.
REFERNEARNNOW.IN SHALL NOT BE HELD RESPONSIBLE FOR THE NON-AVAILABILITY OF THE APPLICATION DURING PERIODIC MAINTENANCE OPERATIONS OR ANY UNPLANNED SUSPENSION OF ACCESS TO THE WEBSITE THAT MAY OCCUR DUE TO TECHNICAL REASONS OR FOR ANY REASON BEYOND REFERNEARNNOW.IN'S CONTROL. THE USER UNDERSTANDS AND AGREES THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE APPLICATION IS DONE ENTIRELY AT THEIR OWN DISCRETION AND RISK AND THEY WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO THEIR COMPUTER SYSTEMS, MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL AND/OR DATA.
YOU FURTHER AGREE AND ACKNOWLEDGE THAT THAT WE ARE IN NO WAY LIABLE FOR THE FUNCTIONING AND NON FUNCTIONING OF THE OTHER SHOPPING APPLICATION WHICH YOU SHALL BE REDIRECTED TO UPON CHOOSING THE APPROPRIATE COUPON/OFFER. WE SHALL NOT BE LIABLE FOR ANY DEAL OR COUPON WHICH HAS TERMINATED OR INVALIDATED BY THE THIRD PARTY SHOPPING SITES. REFERNEARNNOW.IN.IN CASHBACK / CREDITS IS A REWARD SCHEME WHICH IS SUBJECT TO VARIOUS TECHNOLOGICAL AND COMMERCIAL CONDITIONS.
